This area deals with identifying and interpreting the impact of government regulations and law on the organization; identifying the need for and working with others to develop new regulations and laws; investigating, monitoring, documenting, and enforcing existing statutes; and maintaining communication and cooperation with both public and private organizations.

1. The organizaton (or its employees) owed a duty to the patient. 2. The organization (or its employees) violated that duty. 3. As a result the patient was harmed. 4. The injury was a reasonably foreeable consequence of the organizations action or inaction. Can anyone give an example of neglient action in a clinical setting? Thursday July 8, 2010

In an increasingly litiginous society and a complex legal environment, I wonder how most hospitals administrators are dealing with these issues? How much of the work is done by in house attorneys and how much is fee based ? What areas is it essential to get outside legal consultation? e.g. Malpractice? Contracts? Labor contracts? etc.

Are there many CEOs and COOs with law degrees? With the daunting amount of laws and regulations that must be considered, it seems a law background might be helpful. Regardless, a major challenge for healthcare providers is to manage their risk in these areas without paralyzing their ability to progress and be innovative.
