Taft-Hartley Act and Good Faith Bargaining
Posted by: Dan Wood on January 6, 2009 at 4:19PM EST
I'm pretty sure that the NLRB would probably fine the healthcare organization for any bad faith bargaining, but what would happen to the union if they were praticing bad faith bargaining? Can the union leaders be fined or would they just lose their union status?

The cynic in me thinks that h*** would freeze before the NLRB would sanction a labor union for any reason. It does happen, however, but my labor law counsel tells me that is typically in cases when one union attempts to "take over" another union's representation authority.

The NLRB is not a place where I expect the rights of the employer to receive credible standing.

It is interesting but I may be challenging this very question with my own bargaining unit very soon. Our labor counsel is very slowly evaluating the situation prior to filing a charge because we know it will an uphill battle. We settled a new contract in August and they have grieved implementation of every piece of new language. We will see.
